If the tenant terminates the contract before the rental period begins, without naming a successor tenant to take over the same contract under the same conditions, the following prorated rents must be paid as compensation, taking into account saved expenses, unless alternative renting is not possible:
For the calculation of cancellation deadlines, the same calendar date as the rental start date is used, with one or two months subtracted. However, the landlord will make efforts to re-rent the property. The tenant may prove a lower level of damage at any time. If the tenant breaks off the stay early, they remain obligated to pay the full rental price. Cancellations or terminations must be made in writing. The date of receipt of the declaration by the landlord is decisive.
The tenant is required to take out liability / business liability insurance before the start of the rental period, covering the intended usage risk in full. The tenant guarantees that such insurance is in place. Upon request, proof of this insurance must be provided to the landlord at the latest by the start of the rental period.
The tenant is entitled to use the following facilities during the rental period within the building’s opening hours: toilets and access corridors to reach the rented premises. The normal opening hours of the building are from 8:00 AM to 6:00 PM daily. The agreed daily rental price refers to a maximum usage duration of 10 hours within these hours. Any usage beyond this must be agreed upon separately. Usage ends at the latest by midnight (24:00). For any use exceeding 10 hours, an additional charge of 10% of the agreed gross daily rental price (excluding special services) will be applied for each additional hour.
The rental property, including the furniture and any other items within it, must be treated with care. The tenant is responsible for ensuring that any accompanying or visiting persons act with similar care. The tenant is liable for any damage to the rental property, furniture, or other items within the rental property caused by them or by persons accompanying them.
The tenant/organizer must designate a responsible event manager to the landlord. This person must familiarize themselves with the premises and their facilities before the event begins. For this purpose, they will be given a tour of the premises and their facilities by the landlord or a representative, and they must confirm this in writing at the landlord’s request before the event starts. The event manager is responsible for the safety of the event and compliance with regulations. They must be present throughout the entire event, including setup and teardown, as well as any rehearsals.
The tenant must verify the proper functionality and condition of the rental property upon taking possession. The rental property is considered to have been accepted in proper condition unless any defects are explicitly noted at the time of handover.
If permits are required for the event or if notification obligations exist, these must be obtained or fulfilled by the tenant.
The right to use the rental premises is granted exclusively to the tenant. Subletting or any other transfer of the premises to third parties is not permitted.
The exclusive lessees/operators of the catering services at Black Forest Studios, Kirchzarten, are the landlord’s approved catering partners. Additional catering partners are excluded unless explicitly approved by the landlord under a special agreement.
Any changes or additions to this contract must be made in writing. This also applies to any changes to this written form requirement clause. Should any individual provisions of this contract be or become ineffective or unenforceable, the effectiveness of the remaining provisions will not be affected. The ineffective or unenforceable provision will be replaced by a valid and enforceable provision that most closely aligns with the economic intent the parties aimed to achieve with the ineffective or unenforceable provision. The place of jurisdiction is Freiburg im Breisgau. This contract is governed by the laws of the Federal Republic of Germany, unless the tenant does not have a residence in Germany.
